Abstract

In this chapter, we explore the legal landscape of rape in England and Wales and the challenges practitioners face when prosecuting alcohol-related cases. This includes a discussion of cases in the superior courts in England and Wales that have addressed the issue of alcohol-related rape. The chapter also discusses research that has examined in depth the views of counsel who defend and prosecute rape cases. The results highlight the challenges faced in prosecuting alcohol-related rape, the inadequacy of the existing legal provisions, and the importance of appropriate case-building strategies. The extant body of research highlights the need for the development and adoption of evidence-based guidance to improve the investigation, and ultimately the prosecution, of alcohol-related rape cases.
