Abstract

Explores and critiques the substantive criminal law as it applies to delusional and irrational defendants, focusing on rules relating to intoxication, insanity, automatism and mistake. Uses the case of Taj [2018] EWCA Crim 1743; [2019] Crim. L.R. 167 to illustrate significant problems in this area, and criticises it for exacerbating many of them. Argues for specific common law clarifications.
