Abstract

Considers the background to the introduction of the Youth Justice and Criminal Evidence Act 1999 s.28, which allows pre-recorded cross-examination to be secured ahead of trial. Draws in interview evidence from 25 criminal barristers on how s.28 is operating, its suitability for different witnesses an the practicalities of its use.
